Please read our terms and conditions of our services.
1. Service Description: Our Services include GPS tracking solutions designed to track the location of vehicles, assets, and to recover assets in the event of theft using GSM & GPS technology.
2. Account Registration: To access our Services, you must have an active subscription / account. You agree to provide accurate and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must update us / Eco Trak LTD in the event of any personal or vehicle details changing.
3. Use of Services: You agree to use our Services only for lawful purposes and in accordance with these Terms and any applicable laws and regulations. You may not use our Services to engage in any illegal or unauthorised activities. We allow tracking in EU countries however this is on the basis the vehicle is only making a journey into the EU for a holiday. If the vehicle is going to be staying in the EU for a long period, an additional data charge will be charged to your account. Non payment will result in us suspending our services.
4. Privacy: We are committed to protecting your privacy. Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our Services, you consent to the collection, use, and disclosure of your personal information to us Eco Trak Ltd and our secure monitoring center.
5. Data Ownership: You retain ownership of all data and information that you input into our Services. However, by using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such data and information solely for the purpose of providing the Services to you. We will not sell or forward your data.
6. Fees and Payment: The use of our Services may be subject to payment of fees. You agree to pay all fees associated with your use of the Services in accordance with our pricing schedule. Subscription Fees are non-refundable due to them being software & Data based. The subscription can’t be transferred to a new owner. It is your responsibility to make sure the subscription is active for your vehicle, we hold no liability for renewals or reminders. You also must make sure your insurance are still happy with the current level of protection ( Thatcham S7 or Thatcham S5 ).
7. Term and Termination: We issue 12 months subscription will all our tracking products, we may suspend or terminate your access to the Services at any time for any reason, with or without notice.
8. Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of your use of the Services or your inability to use the Services.
9. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to Terms: We reserve the right to modify these Terms at any time, effective upon posting the modified Terms on our website. Your continued use of the Services after the posting of the modified Terms constitutes your acceptance of the modified Terms.
11. Additional charges will apply for excessive data use in EU countries. (example a car stored in the EU for 8 months of the year. Then only present in the UK for 4 months).
12. Thatcham S5 devices being downgraded to S7 devices due to excessive ID Tag alerts ( example owner refuses to carry tag when driving the vehicle / owner won't change battery inside the ID tag ). If the device is downgraded to a Thatcham S7 we will put a note on your tracking system under custom fields in your portal or mobile smartphone app, it will state the following ( Eco Trak Alerts - ID Tag Alerts Disabled ). It's strictly the vehicle owner who is responsible for making sure a Thatcham S7 is still accepted by their insurance.
13. Trackers are designed to offer the best chance of vehicle recovery. However there are no guarantees your vehicle can always be recovered in the event of theft.
14. Eco Trak Phone call alerts, if you don't wish to be contacted via phone we can offer email theft alerts. However these are not recommended.
